Levies pursuant to CHP Act in the light of the amendment of the CHP Act
The Act on combined heat and power generation (CHP Act) is actually in amendment and is planned to be published at the end of 2016 in the “Bundesgesetzblatt”. Because of the legal uncertainty resulting from the amendment process of the CHP Act, it is necessary to develop a new levy pursuant to CHP Act based on the current law as well as the federal government draft. The transmission system operators expect that the amendment of the CHP Act will be adopted by the end of 2016 and that the “new” law can be implemented by 1 January 2017. Therefore, the indicative levy pursuant to CHP Act has to take account as a surcharge on the grid fees, during process of rollover. The additional “old” CHP-surcharges, published in the current CHP Act, serve to protect the requirements arising out of the valid law and represent a backup in case the amendment of the CHP Act, contrary to expectations, will not enter into force by the 1 January 2017.

Final consumer group A'
Electricity volumes supplied to final consumers for the first 1,000,000 kWh per point of use.
Final consumer group B'
Final consumers whose annual consumption exceeds 1,000,000 kWh at one point of use pay an additional maximum CHP levy of 0.04 EUR cents/kWh on electricity volumes exceeding 1 million kWh.
Final consumer group C'
Final consumers who are manufacturers or belong to the rail transport or the railway infrastructure sector and whose electricity costs in the previous calendar year exceeded four per cent of turnover pay a maximum of 0.03 EUR cents/kWh for electricity volumes exceeding 1,000,000 kWh
