Levy pursuant to Section 19 (2), StromNEV 

According to the Electricity Network Charges Ordinance (StromNEV) of 25 July 2005 end consumers can apply for individual grid charges pursuant to Section 19 (2) Sentence 1 respectively Sentence 2 of StromNEV.

TSOs are obliged to reimburse operators of downstream electricity distribution grids for any revenues lost as a result of individual network access fees. TSOs are obliged to compensate each other for these payments and their own lost revenues. The lost revenues will be added to the network access fees (Levy pursuant to Section 19 (2), StromNEV) divided among all end consumers.

Section 19 (2) StromNEV – return of payment of 2013 surcharges in 2015

The regulations governing individual grid use charges pursuant to Section 19 (2) StromNEV and to the Section 19 StromNEV surcharge were amended by the Ordinance of 14 August 2013. In a departure from Section 9 (7) sentences 2 and 3 of the CHP Act (KWKG), the cut-off point for payment by final consumers of the full amount of the Section 19 StromNEV surcharge was retroactively increased from 100,000 kWh to 1 million kWh as of 1 January 2012. As a result, it is necessary in 2014 to return payment of the Section 19 StromNEV surcharge for 2012 and 2013 and to reapply the surcharge in line with the amended regulations.

The difference between the expected and actual income from the surcharges, determined within the scope of the 2013 statement of accounts for final consumer groups A, B and C (with a cut-off point of 100,000 kWh), must be levied by means of a separate corrective surcharge in 2015.

Final consumer group A'

Electricity volumes supplied to final consumers for the first 1,000,000 kWh per point of use.

Final consumer group B'

Final consumers whose annual consumption exceeds 1,000,000 kWh at one point of use pay an additional maximum Section 19 StromNEV surcharge of 0.05 EUR cents/kWh on electricity volumes exceeding 1 million kWh.

Final consumer group C'

Final consumers who are manufacturers or belong to the rail transport or the railway infrastructure sector and whose electricity costs in the previous calendar year exceeded four per cent of turnover pay a maximum of 0.025 EUR cents/kWh for electricity volumes exceeding 1,000,000 kWh
